1. What triggers a DMCA notice<\/h2>\n

A DMCA notice applies when you own, or are authorised to represent the owner of, a copyrighted work that is hosted on or linked from ocubitai.com in a way you believe is infringing. The procedure is modelled on 17 U.S.C. \u00a7 512(c)(3).<\/p>\n

2. What a valid notice must include<\/h2>\n

  1. Physical or electronic signature of a person authorised to act on behalf of the owner.<\/li>\n
  2. Identification of the copyrighted work (title, URL, registration number if any).<\/li>\n
  3. Identification of the allegedly infringing material (URL on ocubitai.com is best).<\/li>\n
  4. Your contact: full legal name, mailing address, telephone, email.<\/li>\n
  5. A statement of good-faith belief that the use is not authorised.<\/li>\n
  6. A statement of accuracy, under penalty of perjury, that you are authorised to act for the owner.<\/li>\n<\/ol>\n

    3. Where to send it<\/h2>\n

    Email the designated agent at dmca@ocubitai.com<\/a>. Subject: DMCA NOTICE<\/strong>. Physical address available on request to verified counterparties at legal@ocubitai.com<\/a>.<\/p>\n

    4. What we do when we receive a valid notice<\/h2>\n
      \n
    • Acknowledge within 2 working days.<\/li>\n
    • Review the notice for validity.<\/li>\n
    • Remove or disable access and notify the person who posted it.<\/li>\n
    • Keep a record for transparency reporting.<\/li>\n<\/ul>\n

      5. Counter-notice procedure<\/h2>\n

      If your content was removed in error, you can file a counter-notice containing: signature; identification of the material and its prior location; a statement under penalty of perjury of good-faith belief it was removed in error; your name, address, telephone, and consent to the jurisdiction of your country (or ours, if outside the US), with acceptance of service of process from the original notifier.<\/p>\n

      If valid, we may restore the material 10\u201314 working days later unless the original notifier files for a court order.<\/p>\n

      6. Repeat infringers<\/h2>\n

      We terminate the accounts of repeat infringers in appropriate circumstances.<\/p>\n

      7. False claims<\/h2>\n

      Filing a knowingly false DMCA notice exposes you to liability under 17 U.S.C. \u00a7 512(f). Please do not use the DMCA process to silence critics, suppress commentary, or settle unrelated disputes.<\/p>\n

      8. For non-US and parallel regimes<\/h2>\n
